(PDHI) of the submittal of a Stage 2 Abatement Plan Modification Proposal for the former PDHI smelter site near Playas, NM to the New Mexico Environment De- partment (NMED), as follows: 1 .The responsible party is: Phelps Dodge Hidalgo Inc. 1 Smelter Road Playas, NM 88009 2. The site is located approximately 10 miles south of the town of Playas, NM, T 29S R 17W Sec 26. 3. Groundwater at the former Hidalgo smelter site has been detected above state groundwater quality standards. PDHI holds a groundwater discharge permit, DP-311, for the former Hidalgo Smelter, which has required PDHI to implement corrective action and re- quires abatement of the groundwater contamination in accordance with the regulations adopted by the Water Quality Control Commission. NMED has approved PDHI's Stage 1 Abate- ment Plan for investigation of the im- pacted groundwater. The Stage 2 Abatement Plan Modification pro- poses selection of the preferred abatement option of ceasing opera- tion of the existing interceptor well system and monitoring groundwater elevated in sulfate, total dissolved solids, as it flows toward and into the playa area. Some elevated metals upgradient of the current extraction well system will also be monitored. The groundwater in the playa ex- ceeds state standards due to natural processes, and exceeds the total dis- solved concentration limit of 10,000 milligrams per liter required to be pro- tected for possible domestic or agri- cultural use. The flora and fauna of the playa are naturally adapted to saline conditions (elevated sulfate and other salts), and are expected to ben- efit by the additional availability of water to the playa. Continued moni- toring is a key component of the pro- posed plan. 4. Because achievement of New Mexico numeric groundwater quality standards for sulfate and total dis- solved solids is not believed to be possible due to geochemical reasons, evaluation of the performance of the preferred abatement option is pro- posed for a minimum of 2 years. Thereafter, an analysis of the data will be performed to determine whether it is appropriate to petition for Alterna- tive Abatement Standards, or if other operational changes should be con- sidered. 5.The Secretary of Environment will review the Stage 2 Abatement Plan Modification proposal following an opportunity for public comment, in- cluding a possible public meeting or a hearing as described below, and will either approve the proposal or notify the responsible person of any defi- ciencies. If no public meeting or hear- ing is held, the Secretary shall notify the responsible person of approval or any deficiency within ninety (90) days of receiving the proposal. If a public meeting or hearing is held, then the Secretary shall notify the respon- sible person of approval of the pro- posal or of any deficiencies, based on the information contained in the proposal and information submitted at the meeting or hearing, within sixty (60) days of receiving all required in- formation. If the Secretary notifies the responsible person of deficiencies in the proposal, the responsible person is required to modify the proposal to cure the specified deficiencies within thirty (30) days of receipt of notice of the deficiency. If the requirements of the abatement regulations are met, the Stage 2 Abatement Plan Modifi- cation proposal will result in the stan- dards and requirements of section 20.6.2.4103 NMAC being met within a schedule that is reasonable, given the particular circumstances of the site, and the Secretary shall approve the Stage 2 Abatement Plan Modifi- cation proposal. 6. This notice is intended to notify the public that the Stage 2 Abatement Plan Modification proposal is being made available for public comments and requests for a public meeting or hearing.
